The Master of the Rolls has asked the Civil Procedure Rule Committee (CPRC) to review the Pre-Action Protocols (PAP). The amendments reflect the recommendations in the final report of Lord Justice Jackson reviewing litigation costs (Review of Civil Litigation Costs, Final Report 2010) and clearly set out the consequences of non-compliance with the protocols. The CPRC is taking the opportunity to update references and links, remove out of date sections and to include common sections such as a stock take stage where appropriate in all the Pre-Action Protocols. Mr Justice Sales is leading on the redrafting.

The CPRC invites written responses on the detail of the Pre-Action Protocol for Judicial Review and any observations the ACO wish to make on the Home Office document. Responses to both documents should be sent to Jane Wright, Post Point 4.32, Ministry of Justice, 102 Petty France London SW1H 9AJ, or paps_consultations@justice.gsi.gov.uk. Please include “Judicial Review PAP Consultation” in the subject line of your email. The closing date for responding to the consultation is 7 November but is extended to 14 November 2014.
